Welcome to ShoplitAI ("Service"), an AI-powered shopping assistant app developed and operated by ShoplitAI ("we," "us," or "our"). 5.1. General Functionality

ShoplitAI is an AI-powered shopping assistant that provides product recommendations, price comparisons across multiple retailers (including but not limited to Amazon, Best Buy, Costco, Target, Walmart, Lowe's, Home Depot, and others), deal alerts, price monitoring, and shopping insights. However, ShoplitAI is not a substitute for your own judgment when making purchasing decisions.

5.2. AI Outputs

The outputs from ShoplitAI, including product recommendations, price comparisons, and shopping insights, are generated using large language models and AI algorithms. These outputs might not always be accurate, complete, up-to-date, or reflect the most current pricing or product availability. You acknowledge that all outputs and responses are provided on an "as is" basis.

We do not guarantee that our recommendations will result in savings, that prices are always accurate, or that products will be available at the prices or retailers we suggest. Always verify product information, pricing, and availability directly with retailers before making a purchase.

5.3. Third-Party Retailers

ShoplitAI may provide links to third-party retailer websites and may receive compensation when you make purchases through these links. We are not responsible for the products, services, pricing, availability, or terms of sale offered by third-party retailers. Your interactions with retailers are subject to their respective terms of service and privacy policies.

5.4. Updates and Improvements

We may, at our discretion and without obligation, update, improve, or change the functionality of ShoplitAI. We do not guarantee that any specific feature or part of the Service will always be available.

6. User Conduct

When using ShoplitAI, you agree NOT to:

• Violate any applicable laws, regulations, or these Terms.
• Use the Service for any unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable purpose.
• Attempt to gain unauthorized access to, interfere with, or disrupt any servers or networks connected to ShoplitAI.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use ShoplitAI for your personal, non-commercial use. This license does not include:

• Any derivative use of the Service or its contents.

While ShoplitAI is designed to help you find better deals and save money, we do not guarantee that you will achieve any specific level of savings or that our recommendations will result in cost savings. Actual savings may vary based on numerous factors beyond our control.

9.3. Price and Product Information

We strive to provide accurate price and product information, but we do not guarantee the accuracy, completeness, or timeliness of any information provided. Prices, product availability, and specifications are subject to change without notice. Always verify information directly with retailers before making purchasing decisions.

9.4. Limitation of Liability

To the maximum extent permitted by law, ShoplitAI and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service.
• Any errors or omissions in the Service or recommendations.
• Any products or services purchased through third-party retailers linked from our Service.
• Any unauthorized access to or use of our servers or your account.
• Any interruption or cessation of transmission to or from the Service.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim, or $100, whichever is greater.

You agree to defend, indemnify, and hold harmless ShoplitAI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Termination

We may terminate or suspend your access to ShoplitAI immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion features in the Service. All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of Calgary, Alberta, Canada.

If you are located outside of Canada, you agree that any disputes will be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association, except where prohibited by law.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

14. Entire Agreement

These Terms constitute the entire agreement between you and ShoplitAI regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms.
